NOTICE
The FRA Administrator’s Declaration of
Emergency Event
Pursuant to Title 49 of the Code of Federal Regulations (CFR) § 211.45, the Federal Railroad Administration’s (FRA) Administrator, Joseph C. Szabo, has determined that the severe winter storms and blizzards in the Great Plains, the Midwest, Mid-Atlantic and Northeast constitute an “emergency event” as related to railroad operations. In making this determination, the Administrator notes that the numerous Governors have declared states of emergency and/or have activated the Emergency Operations Centers in New Jersey, New York, Missouri, Wisconsin, Illinois, Indiana, Ohio, Connecticut, Massachusetts, Pennsylvania, Delaware, Virginia, and Texas. Moreover, the Federal Emergency Management Agency (FEMA) has activated the National Response Coordination Center and seven of its Regional Response Coordination Centers. Therefore, the Administrator has activated the Emergency Relief Docket (FRA-2011-0003) as of February 2, 2011, and the emergency relief provisions of 49 CFR § 211.45 are in effect.
